General

These Terms and Conditions apply to all transactions between you and The Sewing Studio Ltd. Please read them carefully. They do not affect your statutory rights. We may change these Terms and Conditions at any time. Any changes will take effect on the date they are posted on our website.

These Terms and Conditions are governed by English law and are subject to the non-exclusive jurisdiction of the English courts. We do not accept amendments to these Terms and Conditions. Failure by us to enforce any of these Terms and Conditions will not affect our right to enforce the rest of these terms and conditions.

Customer Orders

We will treat each order for goods as an offer by you to purchase the goods subject to these terms and conditions.

To order goods over the telephone or on our website, you must be at least 18 years of age and accept delivery within the UK. All telephone orders will be acknowledged verbally at the time of order, and all orders placed on our website will be acknowledged electronically by e-mail. Please note that verbal and/or electronic acknowledgements do not constitute order confirmation or order acceptance. Your order will be accepted and the creation of a legally binding contract between you and us will take place once the goods have been dispatched or collected. (Alternatively, we may decline all or part of your order for any reason, in which case we will inform you in-person or by telephone or e-mail).

When deciding whether or not to accept your order we may use certain information about you, including any received from credit reference agency checks. This helps to protect you and us against fraudulent transactions.

We will tell you if your payment details cannot be authorised for any reason and may invite you to pay by another method or suggest that you (re-)visit one of our nationwide stores.

Prices

The total price payable will be stipulated at the time when you place your order whether or not the order has been acknowledged. We are entitled to make adjustments to the price to take account of any increase in our suppliers' prices, or the imposition of any taxes or duties, or if due to an error or omission the price published for the goods is wrong whether or not the order has been acknowledged. We will inform you of the correct price and give you the opportunity to cancel the order. Prices in GBP are inclusive of VAT, all other currencies are exclusive of VAT, taxes and duties, these will be calculated at the checkout. All prices are exclusive of delivery charges which will be payable as indicated at the time the order is placed.

From time to time the prices displayed on our website may be different if you are directed to it from a third party website. Purchases at these prices can only be made on our website and by arriving on it through a relevant third party website; these prices will not be available in-store or over the telephone.

Prices, offers and products are subject to availability and may change before (but not after) we accept your order. If a product becomes unavailable we may offer you an alternative or suggest that you (re-)visit one of our stores.

On occasion, the prices payable and promotions offered in respect of goods advertised on the website may differ from those prices and promotions offered at the same time in-store. We are under no obligation to honour any in-store price or promotion in the event that they differ from those on the website. Similarly, our store is under no obligation to honour any website price or promotion in the event that they differ from those in-store.

Although we endeavour to ensure that all pricing information on the website is accurate, occasionally an error may occur and goods may be mispriced. If we discover a pricing error we will, at our discretion, either: contact you and ask you whether you wish to cancel your order or continue with the order at the correct price; or notify you that we have cancelled your order. We will not be obliged to supply goods at the incorrect price.

Prices that are reduced for sales and promotions are only valid for the specified period.

Low Price Guarantee

Our Low Price Guarantee applies to products that are in brand new condition and in stock with other retailers, this does not include Amazon and Ebay. If you see one of our products at a lower price elsewhere, please contact us to see if we can match it.

Reward Points

Our Loyalty Reward Points Scheme ended on 23/09/2023.

We made the decision to end our Rewards Points program. You can still earn points until midnight on 31st August 2023, and then have until midnight on 23rd September 2023 to redeem points. After this time any unspent points will no longer be available. To take part in our Reward Points program, all terms and conditions must be accepted by the user, including any subsequent updates. By registering and taking part in our Reward Points program you are taken to have read and agreed to these terms.

Points do not have any monetary value, except to the extent specifically provided for by a reward. Points are not property and cannot be redeemed as cash.

Points will be awarded for each eligible transaction made on our website, or in our shop for Reward Points members. Users must be signed up to our Reward Points to begin earning points. Please allow at least 24 hours after shipment for points to appear in your account.

Points cannot be backdated nor transferred from other user accounts, even that of the same user name.

Points are earned for each whole £1.00 spent of the value of each eligible transaction. Simply put, for every pound spent on eligible products, you will gain one point. Under no circumstances can points be sold.

We withhold the reserve to limit point earning eligibility on discounted or promotional purchases.

There may be some transactions which can be made that will not earn points. These may include:
1. Unauthorised purchases for which you are not liable.
2. Purchases made of promotional items noted not to be part of the points campaign.
3. Purchases of gift cards.
4. Refunded purchases.
5. Delivery costs.
Points can be redeemed, at the checkout on our website or in our shop. Your points are converted into a discount code, which you can choose to use straight away or at a later date. When you convert your points for a later date you will receive the discount code via email.

Your Reward Points balance will be reduced when:
• Yourself, or someone authorised by you, uses your points to claim a reward.
• Your points expire, after 365 days
• A refund or reimbursement for a transaction previously made is debited to your user account. This may happen for a number of reasons, such as returning or cancelling unwanted goods or services.
• There has been unauthorised transactions from your account for which you are not liable.
• Points were incorrectly allocated to your points balance.
• If we reasonably suspect you have behaved fraudulently in connection to your loyalty account and are not entitled to points earned.

When points decrease, this will be displayed by your updated points value in your account. The points value will be calculated using the rate at which the points were originally allocated.

Points in your account must be claimed within 12 months form the date of the transaction earning those points. Points that remain unused after 12 months will expire and be forfeited.

Closure of your account will result in immediate expiration of your points. These points will be immediately forfeited and cannot be reactivated upon creating a new account.

If our Reward Points gets terminated by us, we will notify all users how long they have to use remaining points before final expiration.

No other users are legible to use your points: If for whatever reason we are notified that your account has been compromised and given to another, we reserve the right to instantly expire remaining points. Should this happen incorrectly please contact us immediately.

We may terminate our Reward Points at any time acting reasonably. Where possible, we will give you at least 30 days’ notice of the termination and cancellation of your points account (if applicable).

If we give you notice after termination, points will only continue to be credited to your Points Balance in relation to transactions that occurred prior to the date of termination.

Any notice we give will include the general reasons for termination (if possible), and the time period available to you to use points in your points balance. We will define the time limit remaining before final expiration of all points.

Examples of when we may terminate include, but are not limited to:
1. where you are in default under these terms and conditions or the terms and conditions of another facility that the customer has with us;
2. where we believe on reasonable grounds that the continued operation of the account may cause loss to the Customer or us.
These examples are for guidance only and do not limit our ability to cancel the account.

Order Processing

Your order is sent directly to our secure system for processing. Once we have received your order and payment, our staff will pick, pack and dispatch the item. We will aim to do this the same day for all orders in to our shop Mon-Fri (excl Bank Holidays).

Gift Cards

Gift cards can be redeemed at thesewingstudio.co.uk, or our physical store located at 12 Chapel Street, Redruth, Cornwall, TR15 2DB. They may be used to purchase goods of the same value or a higher value than the amount on the card, on payment of the difference. If you do not spend the entire balance of the gift card, the remaining balance will stay on the gift card for future purchases. If any item purchased with a gift card is subsequently returned for a refund, any money owing will be added to the original gift card number.

Gift cards should be treated as cash; they are not cheque guarantee, credit or charge cards, however cannot be exchanged for cash, or returned or refunded. The Sewing Studio Ltd will not accept liability for lost, stolen or damaged cards. Gift cards purchased from 27th February 2023 are valid for 24 months from the date of purchase. Gift cards purchased before this date are valid for 12 Months. Any remaining balance will be cancelled on expiry of the validity period.

Gift cards purchased outside the UK adhere to the same terms and conditions above, however in addition to this you are able to purchase and redeem gift cards in your local currency. As this will differ from our currency, a conversion takes place when the gift card is redeemed at the checkout. This conversion uses the exchange rate at the time that the gift card is redeemed, and not the exchange rate that was in place when the gift card was purchased.

If you purchase a gift card as a consumer online or by phone, you have the right to cancel all or part of your order for a gift card at any time up to 14 calendar days after the day on which you place your order, provided none of the balance has been spent.

The Sewing Studio Ltd reserves the right to amend the terms and conditions of gift cards and e-gift cards at any time and to take appropriate action, including the cancellation of the card, if, in its discretion, it deems such action necessary. This does not affect your statutory rights.

Once your order has been despatched, you will receive your tracking reference by email. You can also track your order by clicking the link at the bottom of the this page, or here.

Delivery

All UK Mainland orders over £99 are delivered free of charge. For orders under £99 or outside of UK, delivery is charged as priced on each order. Once you have placed an order it will be dispatched the same day or the next day depending on the time or service chosen when order was placed. If you wish to cancel your order after it has been dispatched, you will be charged for delivery and need to arrange your own safe return of the goods, once a Return Request has been raised by you (see below).

If you are unavailable when our delivery partner tries to deliver your order, they will usually try to deliver again the next working day or they will drop a card in to offer you a collection from a local collection point. If you should refuse delivery of goods, or are not available to accept the delivery on both delivery attempts, you will be required to cover any extra costs incurred.

When using a courier service, certain areas of the UK will incur additional charges, or experience delivery delays longer than advertised. These areas are (but not exhaustive) as follows: Northern Ireland (BT), Isle of Wight (PO30-37), Isle of Man (IM), Scottish Highlands and Orkney Isles (PA, ML, EH, KA, G, KY, PH, DD, AB, IV, KW), Outer Hebrides and the Shetland Isles (HS, ZE).

We will only deliver goods to the address detailed by you on your order.

Some orders can take longer to prepare or require special care due to size and weight, if we suspect your order may get held up we will contact you using the contact details supplied by you on your order. If the cost of delivery to you is significantly higher than the amount paid due to size and weight restrictions we reserve the right to contact you to discuss the charges with a view to amend the amount paid for delivery.

ProtectMyOrder

ProtectMyOrder gives you peace of mind when ordering online with us. It ensures a quick resolution to a delivery issue that may arise, for a small additional fee.

Customers who choose not to purchase ProtectMyOrder can still claim should an issue occur, but may need to wait for the carrier to offer a resolution, which can take upwards of 30 days.

Should your parcel be lost, damaged or stolen in transit, we will prioritise resolving your query. Contact us within 24 hours of the issue and we will promptly initiate an investigation to resolve your issue as quickly as possible.

Requirements
Lost Parcel:

  • Tracking which states ‘delivered’ by the carrier but was delivered to the incorrect address.
  • Tracking which shows ‘in transit’ and without any updates or movement for an extended period of time.
  • Parcels that have been determined lost by the carrier.

Damaged Parcel:

  • If any of the item(s) in your parcel or the packaging arrive broken.
  • In all instances we require photos of the packaging including the carrier label, and the affected goods.
  • To be eligible you must notify us of an issue with the delivery within 24 hours of the delivery date.

Stolen Parcel:

  • Tracking states ‘delivered’ but you haven’t received it.
  • For instances where a parcel is delivered not received or stolen, you will need a police report.
  • To be eligible you must notify us of an issue with the delivery within 24 hours of the delivery date.

Exclusions:

A delivery issue caused by the delivery address provided by you at the time of placing your order being incomplete or inaccurate.

Parcels that are delayed in transit due to adverse weather conditions or carrier issues are deemed as delayed rather than lost.

Claims showing proof of delivery to the correct address, supported by carrier-supplied photographic evidence, GPS-verified delivery location, and satellite imagery.

A delivery issue where a safe place or alternative address has been requested.
Refusal to co-operate with carrier services to ensure safe delivery.

Orders or parts of orders that have not yet been despatched.

Parcels that have already been replaced or refunded.

Orders sent to PO boxes, parcel collection points, drop of points, or similar.
If you have changed the delivery address after we have despatched your order then your delivery is not protected under ProtectMyOrder for any delivery issues that may arise.


Resolution

Once you have notified us of an issue with your delivery, we will contact you requesting any further details or documentation required to raise a claim. We will then begin an investigation with the carrier for a resolution. The length of this process can vary and could take up to 30 days to complete from the time we have all relevant information/documentation.


If a claim is approved, we may provide one of the following resolutions:

  • Replace the lost or damaged item(s) with an identical item(s) previously purchased, this will cover delivery costs but not the cost of purchasing ProtectMyOrder.
  • Refund the cost of the item(s), including delivery costs but not the cost of ProtectMyOrder.
  • Issue a store credit/gift card of the cost of the item(s), including delivery costs but not the cost of ProtectMyOrder.

We reserve the right to deny claims due to fraud and/or abuse and refuse compensation if we are not satisfied with the evidence provided. We reserve the right to handle any claims made on a case-by-case basis and will review all available evidence/ information when deciding on the appropriate course of action to resolve your issue.

Please note that this service is an addition to our standard services, outlined in our terms and conditions. Payment of the additional fee is considered acceptance of this contract.

ProtectMyOrder is optional and can be easily deselected from your shopping cart should you wish to continue without this.

 

Availability

All information provided on the products on this website is intended as a guide only. Dimensions and weights are only approximate, as are colours. If you are ordering goods that are out of stock we will dispatch them when they are received from our supplier.

On occasion goods are subject to availability and delay in delivery of goods is sometimes outside our control. As such, delivery cannot be guaranteed and any dates we specify for the delivery of the goods are approximate only. We shall not be liable for any losses, costs, damages, charges, or expenses caused by any delay for delivery of the goods.

Colour Reproduction

We have made every effort to reproduce colours on our website as accurately as possible. However, different computers and mobile devices reproduce colours in slightly different ways, so exact colour matches are not yet possible over the internet.

This means that when you order products from our website, colours may differ from what you see on the screen. For this reason we detail the main colour of each fabric and offer a sample service.

Returns

When purchasing online you have 30 days from the day of delivery to return any new and unused items. This does not include items that are cut to length. Any promotional items or free gifts must also be returned.  

You MUST raise a Return Request through your account to return any items to us. This request must be submitted within 30 days from the date of delivery. You can access a guide on how to raise a return request here 

Once we have approved your request, we will inform you with instructions on how to return the item(s) to us.  

We will NOT accept returns without a Return Request.    

In any event the consumer must send off the goods intended for return no later than 14 days after approval of the Return Request. After the 14 days, your return will be rejected, and goods made available for your collection.   

Any unwanted items must be sent back at the customer's expense, in all original manufacturing packaging and the condition, as new undamaged, unused and in a resalable condition.    

It is important you do not use or interfere with the product if you intend to return the item, if the item is used or interfered with then it is deemed accepted as supplied, items MUST be unused. If we receive items back in used condition a refund will not be issued and the goods will be made available for your collection or, a partial refund will be offered if the value has been affected by using the item or otherwise damaging it, this includes packaging and accessories and any missing items.  

Products that are cut to length for each individual order, cannot be returned. We deem these products to have been made to order, and as such are exempt from distance selling regulations. Please order carefully.

Where a product is purchased with software included, if software has been opened and/or activated by the customer, the product purchased may not be returned.    

Any software purchased, that has been opened and/or activated by the customer, cannot be returned.    

If a machine has been purchased through one of our finance options, and you have started your repayments, it is not possible to return your sewing machine.   

For any faulty items, we can offer a repair or refund within 30 days of receipt, so long as the fault is not due to accidental damage, misuse or general wear and tear and in all intact packaging. All products will be inspected and tested to establish if the fault is due to a manufacturing problem. You MUST raise a Return Request through your account to return any faulty items to us. This request must be submitted within 30 days from the date of delivery. You can access a guide on how to raise a return request here.

Faults with products over 30 days old but under 6 months old will require investigation and inspection to establish if the fault is due to a manufacturing problem, if it is a manufacturing problem then we will either repair or replace.   

After 6 months it will be down to the consumer to prove it is a manufacturing fault, if it can be proved then we reserve the right to further inspect the product to confirm a manufacturing fault, if after confirming it is a manufacturing fault then we will repair or replace the item.    

When returning items, we suggest for your own protection you choose a tracked delivery service that offers the appropriate insurance for the value of goods being returned.    

Any refunds will be issued once we have received the goods, in their original condition. This refund only includes the total of goods sent, not the delivery charge or ProtecMyOrder fee.    

We will not charge a restocking fee for returned items.    

The consumer must bear the direct cost of returning goods.    

This does not affect your statutory rights.    

For purchases made in our shop, you have 30 days from the date of purchase, to return any new and unused items, along with proof of purchase. This does not include items that are cut to length. Any promotional items or free gifts must also be returned.  

Cancellation

You have the right to cancel your order 14 days from the day after you receive your goods or service. Your right to cancel does not apply to the following products:

  • Items that are cut to length for each individual order such as fabric, ribbon and elastic cannot be returned. We class these as ‘made to order’ and are therefore exempt, unless faulty.
  • Machines that are purchased through finance, cannot be returned if the repayments have started.
  • Software included with a machine, or purchased separately, cannot be retuned once opened.

You must inform us that you wish to cancel in writing, either by letter, or email using the Cancel Order form in our help centre  within a period of 14 days beginning on the day after you receive your goods. You must take reasonable care of the goods and not use them. You should return goods to us in all the original manufacturers' packaging where possible and within 14 days of us approving your return request.  

The consumer must bear the direct cost of returning goods, we suggest for your own protection you choose a tracked delivery service that offers the appropriate insurance for the value of goods being returned.    

Any refunds will be issued once we have received the goods, in their original condition. This refund only includes the total of goods sent, not the delivery charge.    

Law

These Terms and Conditions of Sale shall be governed by the laws of England and you agree to submit to the non-exclusive jurisdiction of the English courts. We are required by law to inform you that sales can be concluded in English only and that no public filing requirements apply.

WEEE Regulations

The Waste Electrical and Electronic Equipment Directive (WEEE Directive) was introduced into UK law in January 2007 by the Waste Electronic and Electrical Equipment Regulations 2006.

The WEEE Directive aims to reduce the amount of electrical and electronic equipment being produced and to encourage everyone to reuse, recycle and recover it.

Distributers of new electronic equipment have a part to play in the amount of WEEE going into Landfill sites. The Sewing Studio Ltd are obliged under these regulations to offer our customers free take-back of their WEEE on a like-for-like basis when they buy a new electronic product from us.

For example, if a customer bought a new sewing machine from us we would accept their old sewing machine and prevent it going into a landfill site by disposing of it safely. Customers must return their WEEE item to us within 28 days of purchasing their new item.

Under the WEEE Regulations, all new electrical goods should now be marked with the crossed-out wheeled bin symbol. Goods are marked with this symbol to show that they were produced after 13th August 2005, and should be disposed of separately from normal household waste so that they can be recycled.

Competitions

When entering competitions with The Sewing Studio, you must agree to the below terms.
  • You are aged 18 or over.
  • You are a resident of the United Kingdom
  • You have valid email address
  • One entry per person per day is authorised.
  • This offer is valid while stock lasts.
  • Entrants may win a maximum of 1 prize each month
  • If you make a refund within the entry period your entry will not be counted.
  • The entry period is from the first of the month until the last day of the month at midnight.

All promotions are subject to availability and while stocks last. We reserve the right to end a promotion at any time and they can not be backdated.

Spend over £300 on our website and receive a 5% discount on eligible products, effective from April 30th, 2024, until further notice. Extended Christmas returns

Purchases made online or in-store from 22nd October 2023 to 24th December 2023, can be returned until 16th January 2024. Items must be new and unused and include proof of purchase.

This does not include items that are cut to length, machines that are purchased through finance, if the repayments have started, or Software that is included with a machine, or purchased separately if opened. Any promotional items or free gifts must also be returned.

For purchases made on or after December 25th, our standard returns policy will be in effect. This does not affect your statutory rights.
